1. Acceptance of Terms

By accessing or using Secure Funding Support’s website, services, or tools (“Services”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.

2. Description of Services

Secure Funding Support provides business funding consulting and brokerage services. We help entrepreneurs and business owners identify and access funding options including but not limited to SBA loans, business lines of credit, equipment financing, revenue-based financing, and merchant cash advances. We act as an intermediary between you and lending partners.

3. Not a Lender

Secure Funding Support is not a lender. We do not make lending decisions, guarantee loan approvals, or guarantee any specific funding amount, interest rate, or terms. All funding is subject to credit approval and underwriting by our lending partners. Results vary based on individual circumstances.

4. Fees and Payments

• On-Boarding Fee: A non-refundable deposit may be required upon signing a Funding Services Agreement. The amount is specified in your individual agreement.
• Performance Fee: A performance-based fee (percentage of the funded amount) is due within 24 hours of funding disbursement. The percentage is specified in your individual agreement.
• No fees are charged for initial consultations or AI-powered funding analysis.

5. Accuracy of Information

You agree to provide accurate, complete, and current information when using our Services. Providing false, misleading, or incomplete information may result in termination of services and could constitute fraud. You are responsible for the accuracy of all information submitted through our application forms, underwriting tools, and communications.

6. AI-Powered Tools

Our Services include AI-powered tools for lead qualification, credit analysis, and funding assessment. These tools provide estimates and recommendations based on the information provided. AI-generated assessments are not guarantees of funding eligibility, amounts, or approval. Final decisions are made by lending partners based on their own underwriting criteria.

7. Electronic Signatures

By using our electronic signature feature to sign a Funding Services Agreement, you agree that your electronic signature has the same legal effect as a handwritten signature. You consent to conducting transactions electronically and to receiving documents in electronic form.

8. Affiliate Program

Participation in our affiliate referral program is subject to additional terms. Affiliates earn commissions on funded deals from their referrals. Commission rates and payment terms are specified in individual affiliate agreements. We reserve the right to modify or terminate the affiliate program at any time.

9. Limitation of Liability

To the fullest extent permitted by law, Secure Funding Support and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of your use of our Services.

10. Termination

We reserve the right to terminate or suspend your access to our Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Sheridan County, Wyoming.
